SwimPro360 is a powerful swimming performance app built for swimmers, who want a smarter way to train, track results, and improve performance.

Designed specifically for competitive swimming, the app combines training logs, race analysis, performance analytics, event management, and AI-powered insights into one seamless platform.

Whether you’re chasing your next Personal Best, building consistency in training, or preparing for competition, SwimPro360 gives you the tools to stay organised, focused, and race-ready every day.

SwimPro360 Terms of Use

1. Acceptance of Terms

By downloading, installing, or using SwimPro360 (“the App”), you confirm that you have read, understood, and agree to be bound by these Terms of Use (“Terms”) and our Privacy Policy. If you do not agree, please do not use the App.

These Terms constitute a legally binding agreement between you and SwimPro360 (the “Company”), registered in England and Wales.

2. Eligibility

  • You must be at least 13 years old to create an account.

  • Users aged 13–17 must have verifiable parental or guardian consent before using the App.

  • By creating an account, you confirm you meet these age requirements or that a parent/guardian has consented on your behalf.

  • Parents or guardians who create profiles for minor athletes are responsible for all data entered and for ensuring the minor’s use complies with these Terms.

3. Account Registration & Security

  • You must provide accurate, current, and complete information when registering.

  • You are responsible for maintaining the confidentiality of your account credentials.

  • You must notify us immediately if you suspect unauthorised access to your account: appsupport@swimpro360.com

  • We reserve the right to suspend accounts with inaccurate information or that pose a security risk.

4. Subscriptions & Payments

  • Subscription fees are processed securely by Stripe. All prices include applicable VAT and are displayed in your local currency.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.

  • Free trials, where offered, are clearly identified before you commit. You will not be charged during a free trial.

  • After a trial ends, the subscription price applies automatically.

  • You may cancel at any time via Settings → Subscription. Access continues until the end of the current billing period.

  • UK / EU Consumers: You have a statutory 14‑day cooling‑off right. Accessing paid features immediately waives this right for content already accessed.

  • Refund requests outside the above are considered case‑by‑case. Contact: appsupport@swimpro360.com

  • We may change subscription prices with at least 30 days’ notice via in‑app and email notifications.

5. Acceptable Use

You agree not to:

  • Use the App for unlawful, fraudulent, or harmful purposes.

  • Enter false, misleading, or fabricated performance data.

  • Harass, abuse, or impersonate any person via the App.

  • Attempt to access another user’s account or data without authorisation.

  • Reverse‑engineer, decompile, disassemble, or copy any part of the App or its code.

  • Introduce malware, viruses, or harmful code.

  • Use bots, scrapers, or automated scripts to access or extract data.

  • Circumvent or attempt to bypass any subscription paywall or security feature.

6. Intellectual Property

All content, design, branding, software code, and AI features within SwimPro360 are the property of SwimPro360 or its licensors.

You retain ownership of the data you enter (profiles, results, training logs). You grant SwimPro360 a limited, non‑exclusive licence to process this data solely to provide App services. You may export or delete your data at any time.

7. Data & Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms. By using the App, you acknowledge you have read and understood the Privacy Policy.

8. AI Features Disclaimer

SwimPro360 includes AI‑generated features such as coaching insights, predictions, training recommendations, and race strategy analysis. These are for informational and motivational purposes only.

  • AI outputs do not constitute professional coaching, medical, or training advice.

  • Always consult a qualified swimming coach before making training decisions.

  • We do not guarantee the accuracy of AI‑generated content and are not liable for decisions made based on it.

9. Limitation of Liability

To the fullest extent permitted by applicable law (including the UK Consumer Rights Act 2015):

  • The App is provided “as is” without warranties of any kind.

  • We do not warrant that the App will be error‑free, uninterrupted, or secure.

  • We are not liable for indirect, incidental, consequential, or special damages.

  • Our total liability is limited to the subscription fees you paid in the 12 months before the claim.

  • Nothing limits liability for:

    • death or personal injury caused by negligence

    • fraud or fraudulent misrepresentation

    • any liability that cannot be excluded by law

10. Service Availability

We strive to maintain App availability but do not guarantee uninterrupted access. We may suspend access for maintenance, security updates, or force majeure events. We will endeavour to notify users of planned downtime.

11. Third‑Party Links & Services

The App may contain links to third‑party websites (e.g., venue maps, app stores). We are not responsible for their content, privacy practices, or terms. Accessing them is at your own risk.

12. Termination

  • You may delete your account at any time via Settings → Privacy → Delete Account. Data is permanently erased within 30 days.

  • We may suspend or terminate accounts that violate these Terms.

  • Upon termination, your right to use the App ends immediately.

  • Certain provisions (e.g., Intellectual Property, Liability) continue after termination.

13. Changes to These Terms

We may update these Terms periodically. Material changes will be announced via in‑app banner and email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance. If you do not agree, you may close your account before changes take effect.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of England and Wales. Disputes fall under the exclusive jurisdiction of the courts of England and Wales.

EU consumers: You may benefit from mandatory consumer protection laws in your country. You may use the EU Online Dispute Resolution platform: ec.europa.eu/odr.
